1 Eligibility and Account Registration
You must be at least 18 years old and a legal resident of the jurisdiction in which you use the Service to create an account. You are responsible for keeping your account credentials confidential, and you accept responsibility for all activity that occurs under your account. Notify us immediately if you believe your account has been used without your authorisation.
2 Licence Grant
We grant you a non-exclusive, non-transferable, revocable licence to install and use our applications on a personal device for your own use. You may not copy, modify, sublicense, or distribute an application or its content without express written permission from Tuak Solutions.
3 User Obligations
You agree not to use the Service for any unlawful purpose or in any way that breaches these Terms. In particular, you agree not to:
- upload or distribute malware or other harmful code;
- impersonate any person or misrepresent your identity;
- engage in fraud or deception of any kind;
- infringe the rights of any third party;
- access any system or account without authorisation; or
- disrupt the normal operation of the Service.
4 Payments and Billing
Where an application supports paid transactions, you authorise us to charge your chosen payment method for the requests you make through it. You are charged when the request is created, and the counterparty is notified once the payment clears. You are responsible for keeping your payment information accurate and up to date.
Where an application supports bookings or scheduled services, cancellation terms depend on how far the request has progressed. Cancelling before work begins or before the other party sets off is refunded in full. Once work has begun or the other party is on their way, a cancellation fee may be retained, and any travel or call-out charge may be paid to them for the journey already made. The application shows you what you will be refunded before you confirm a cancellation. Refunds are processed within 5–7 business days.
5 Intellectual Property Rights
All content in our applications, including text, graphics, logos, images, and software, is the property of Tuak Solutions or its licensors. You may not reproduce, distribute, or transmit any of it without our prior written consent. Unauthorised use of our intellectual property may result in legal action.
6 Disclaimers
THE SERVICE IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
7 Limitation of Liability
Our total liability to you for any claim arising from or relating to these Terms, regardless of the form of action, shall not exceed the amount you paid us, if any, in the preceding 12 months. Some jurisdictions do not allow limitations on liability, so this provision may not apply to you.
8 Indemnification
You agree to indemnify, defend, and hold harmless Tuak Solutions and its officers, directors, employees, and agents from any third-party claims, damages, or costs arising from your use of the Service or your breach of these Terms.
9 Modifications to These Terms
We may modify these Terms at any time. Changes take effect when posted, and we will revise the “Last updated” date above. Your continued use of the Service after a change constitutes acceptance of the updated Terms, so we encourage you to review them periodically.
10 Termination
We may terminate or suspend your account and access to the Service at any time, with or without cause and without notice. On termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will continue in effect.
11 Governing Law and Dispute Resolution
These Terms are governed by the laws of Ghana. Any dispute shall be resolved through binding arbitration in accordance with applicable law, and you agree to waive the right to pursue claims in court or by jury trial, to the extent permitted by law.
12 Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.
